You access our Services on your own initiative and are solely responsible for compliance with all local, regional, and national laws applicable to your specific jurisdiction.

2. Use of Services

You agree to use our Services solely for lawful business purposes related to real estate marketing, client relationship management, and transaction facilitation. You represent and warrant that all information you provide is accurate and current.

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

Prohibited Acts: You agree not to:

• Misuse our integrated "AI Features" to generate content that is illegal, defamatory, discriminatory, or violates international fair housing or anti-discrimination laws.

• Use our lead generation tools to harvest data or "scrape" listings in violation of third-party terms.

• Impersonate another broker or misrepresent your affiliation with a brokerage, Multiple Listing Service (MLS), or regional property board.

3. AI & Automation Tools

Our Services integrate advanced artificial intelligence and automation tools from various third-party providers (including, but not limited to, voice AI, prompt engineering, workflow automation engines, and generative text models).

• No Guarantee of Accuracy (Hallucinations): AI models may occasionally generate incorrect information ("hallucinations"). You acknowledge that you are the final editor and publisher of all content. You are responsible for reviewing all AI-generated property descriptions, blog posts, and client communications for accuracy before publication.

• Voice/Call Recording Compliance: If you utilize our voice AI features for automated calling or virtual receptionists, you assume full liability for complying with all applicable telemarketing, spam, and wiretapping laws in your operating region (e.g., the TCPA in the US, CASL in Canada, GDPR in Europe, or equivalent local regulations).

• Consent Requirements: You are responsible for ensuring that necessary consents (e.g., "This call may be recorded") are obtained from call recipients in jurisdictions that require two-party or all-party consent.

4. Real Estate Data & Syndication

If you utilize our integrated listing widgets, Internet Data Exchange (IDX) solutions, or similar real estate data feeds to display property listings:

• License Validation: You confirm you are a licensed real estate professional in good standing within your respective jurisdiction.

• Board/MLS Compliance: You agree to abide by the specific display rules, compliance policies, and data use restrictions of your local MLS, Real Estate Board, or equivalent governing body. You act as the primary "Participant" for data access; we act solely as your technology provider.

• Data Accuracy: We are not responsible for the accuracy, timeliness, or availability of real estate data feeds provided via third-party vendors or listing portals.

5. Limitation of Liability

To the maximum extent permitted by applicable law, SWEPETY LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to:

• Loss of profits, commissions, or sales.

• Loss of data, leads, or goodwill.

• Service interruptions caused by third-party tools (e.g., website builder outages, portal API changes, e-signature platform errors).

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

PART 2: PRIVACY POLICY

• Service Delivery: To host and render your real estate website, process incoming leads, and execute automated workflows through our chosen infrastructure providers.

• AI Processing: To generate marketing copy, property descriptions, or automated voice responses using our integrated AI partners based on the parameters you set.

• Marketing & Analytics: To manage and optimize advertising campaigns on your behalf via various social media and search engine platforms, and to analyze campaign performance.

• Compliance: To ensure valid license status for property feeds and prevent fraudulent use of our platform.

3. Third-Party Data Processors (Our Tech Stack)

We utilize a flexible suite of trusted third-party providers to operate our business and deliver custom solutions to our clients. By using our Services, you acknowledge and consent to data processing by vendors in the following categories:

• Core Infrastructure & Hosting: Website builders, server hosting platforms, database managers, and workflow automation engines used to sync your leads.

• Real Estate & Data Feeds: Listing syndication tools, IDX providers, and major real estate portals that process search queries.

• Artificial Intelligence (AI): Third-party text generators, chatbots, email drafters, and voice agents. Data sent here is used to generate responses and is generally not used to train public models unless explicitly stated by the provider.

• Digital Marketing & Ads: Social media advertising platforms and search engine marketing (SEM) tools used for retargeting, lead-generation ads, and tracking visitor behavior.

4. International Data Transfers

• Data Controller: SWEPETY LTD serves as the Data Controller for your account information.

• Cross-Border Transfer: We are a company based in the United Kingdom, serving a global client base. Our technology stack utilizes servers located in multiple international jurisdictions (primarily North America and Europe).

• Safeguards: We ensure your data is protected during international transfers by complying with the UK GDPR. We rely on adequacy decisions, Standard Contractual Clauses (SCCs), and equivalent international data protection frameworks to legitimize data flows across borders.
